Reading the fine print

Your Tender, Price & Payment 7
General

Your price is based on site and soil conditions to suit your particular site (unless otherwise stated) and includes Portable Long Service Levy, QBCC Insurance, engineered frame and roof trusses as per the Building Code of Australia. Please note any items not specifically noted in the above contract have not been included. Should you require additional clarification or items added to your contract, please let us know.

Variations

Your builder charges a $350.00 administration fee for each and every variation requested by the Owner, or a change from the above contract that occurs on site, subsequent to execution of the contract and completion of colour and inclusion selections. Variations are changes, additions, deletions and all alterations to contract, colour selection, allowances, or prior variations. All variations are subject to your builder's approval and are to be paid for in full prior to work commencing. The Owner is NOT to give any directions to any sub-contractor regarding changes to plans or specifications. All requests for changes must be made directly to your builder so your Builder always remains in full control of your job.

Provisional sums

LanCon uses its best endeavours to estimate the cost of an item in the tender; however, sufficient detail is not always available at the time and cannot be determined until further design or detailed plans are prepared. All effort will be made to determine the fixed price by the time a contract is prepared. Final costs on provisional sums will be calculated at cost plus builder's margin as per the Master Builders Contract.

Price increases and stock availability

In the event of a Global Event which limits the supply of materials, and therefore escalates the cost of a product, LanCon reserves the right to pass the cost on to the client, with a 20% builder's margin. A Global Event is such as a major weather event, natural disaster, or a political event such as war or trade restrictions which directly results in an increase in the price of the particular material.

Expiry date

Due to changes in labour rates and building materials, tender pricing issued from LanCon is only held for 60 calendar days. Should you have an expired tender price, please contact your sales person to provide you with a revised tender.

Insurance of your building during construction

Your Builder insures your home against material loss or damage during construction with a builder's all-risk policy with an approved insurance agency. Your builder pays the applicable excess if the need arises to make a claim. (Note: insurance does not cover materials bought on to or left on site by Owner or Owner-supply items.) This policy expires at the time of handover. Any variations will attract additional insurance charges to be calculated and submitted to you for payment with your claim payments.

Fees and charges

It is the Owner's responsibility to pay any charges and fees not directly related to building work, such as infrastructure charges (e.g. for roads) and any non-building charges. Any bonds required to be paid are the responsibility of the Owner. Any additional fee related to a Relaxation Application to BCC and certifier administration fees are at the expense of the owners. Please note Relaxation Applications can add up to 6 weeks on pre-administration time.

Site, Earthworks & Access 13
Earthworks

Unless otherwise allowed for in the contract, all survey pegs will be required prior to the commencement of any earthworks. The Owner will be responsible for identifying and replacing any and all missing or displaced survey boundary marks at additional cost to the Owner. Prior to completion, LanCon will clear rubbish from the site and re-establish falls away from the dwelling. Any future change to the final levels by the Owner may negate any warranty given by LanCon regarding termite inspection zones or building performance. LanCon will provide site drainage in accordance with the BCA. Yard gullies to assist in drainage of excess groundwater will be subject to future variations.

Concrete works

As per engineering, step-up bedding to bathrooms to allow fall for the floor waste. All concrete slabs and footings are constructed in accordance with the Engineer's design and report and AS2870.1. Foundations must be prepared so that footings are placed on level undisturbed material. Finish to internal monolithic slabs including garages is a steel-trowelled finish. Finish to external monolithic slabs is a broom finish unless otherwise specified in the working drawings. Note: due to product inconsistencies in concrete and changing environmental site conditions, LanCon is unable to guarantee against shrinkage cracking in excess of tolerances provided for in the QBCC Standards and Tolerances Guide.

Spoil removal

Unless otherwise allowed for under the contract, no allowance has been included for the removal or disposal of spoil material or loose material dumped from adjoining building works. Should any stockpiled spoil on site interfere with the construction, the stockpiled spoil will be removed from site on the owner's behalf and at the owner's expense, and a variation to the contract will be issued in accordance with Clause 19 of the General Conditions of Contract.

Rock

Unless otherwise allowed for under the contract, no allowance has been included for rock excavation or rock removal and disposal (including associated costs). Rock is deemed as any material unable to be excavated or ripped using standard drott or backhoe machinery. Any additional costs will be payable by the owner when rock is encountered on site — from either excavation from the site cut, piers/footings, retaining walls, driveway shaping or trenching for services. Any additional costs due to rock will be invoiced with builder's margin as per the Master Builders Contract.

Fill

Unless otherwise allowed for under the contract, no allowance has been made to remove existing structures, rubbish, rubble, fencing, retaining walls or any other material from site. It is the owner's responsibility to ensure the site is clean and has free access for the builder to commence works. No allowance has been made for sites requiring special management due to fire ants.

General site conditions

If the builder proceeds to commence works in accordance with the contract and the site is not clean and/or does not have clear access available, then any additional works to clean the site and make good ready for commencement will be undertaken by the builder and all associated costs will be included in a variation to the contract to be executed in accordance with Clause 19 of the General Conditions of Contract.

External works

Unless otherwise stated, allow for level house site, by Owner. On acreage sites, the Owner is to stake the four corners of the house before excavation commences. If rock is encountered, excavations will be charged as an extra to the Contract. Surplus material to be spread/stockpiled over the site. Excavated material, soil, trees, etc. to be stockpiled on site. Your builder will include a vegetation scrape to 300 mm to the house pad only. Unless stated, retaining walls, rock excavation, cut & fill and soil removal are not included in this contract. Unless otherwise allowed for under the contract, no allowance has been included to remove or repair damage from tree roots which have affected any existing services. If any works are required due to tree roots or council protected trees, all additional costs will be the responsibility of the owner.

Tree removal

Unless otherwise allowed for under the contract, no allowance has been included for tree or stump removal (including grinding) in the building envelope or zone of influence unless specifically noted otherwise. Should the Engineer determine that surrounding trees may influence the integrity of the foundations, the owner is to provide an arborist report. Recommendations within the report MUST be implemented by the owner. Warranty of the slab will be voided if the owner ignores the arborist's recommendations. Where owners are removing any trees in the zone of influence, it shall be the owner's sole responsibility to install root barriers to all remaining trees on or affecting the site.

Site access

Site access is the responsibility of the Owner. Any costs incurred by the Builder due to difficult site access, including hand-carting of materials and/or additional crane hire, will be at extra cost to the owner. Examples of additional costs that may apply are (but not limited to): additional crane hire, materials handling, additional scaffold requirements, concrete pumping, out-of-hours work, traffic control, associated permits and fees. Any work carried out to achieve suitable site access will be at the cost of the owner and may incur an extension of time. The Owner is to give notice to LanCon's site supervisor to arrange a mutually agreed time to visit the building site at a reasonable time during work hours. The Owner will be able to inspect the works at the following stages: slab complete, roof cover complete, internal linings complete, external claddings complete, prior to tiling, and a pre-handover inspection. Site visits may be restricted at any other time and must be arranged with the Site Supervisor prior to entering the site. If you do enter the site unaccompanied by the site supervisor, you will be politely asked to leave by any trade contractor working on the site and to phone the site supervisor to arrange a time to visit. LanCon understands you are keen to see the progress of your new home and are not always available to inspect the home during normal working hours; however, we have obligations under law to protect all people on a construction site. If you choose to visit the site outside of normal working hours, you do so at your own risk and LanCon can assume no liability whatsoever. If any security gates are in place, the gates must be closed again on exit from the site and all care must be taken around scaffold, void platforms in stairwells and rubbish cages.

Existing kerbs

LanCon takes no responsibility for damage, either existing or due to the construction on the site, because of the access required by delivery trucks and construction vehicles. Heavy equipment is used in the building industry and even with extra care, damage to existing improvements can occur. The Owner will be responsible for all associated repair costs.

Foundation data

Your Building Contract is dependent on us receiving a Soil Test and Slab Design, consisting of Engineer tests for Foundation Data and Slab Design. Construction of the slab will be in accordance with QBSA requirements for the site class.

Identification survey

Unless otherwise allowed for under the contract, no allowance has been included in the scope of works for survey peg reinstatement. Survey pegs are required to be in place before works commence on site. The owner is to confirm that sufficient pegs are in place before works commence. Should survey pegs not be in place when works commence, a licensed surveyor will be engaged to reinstate the pegs on the owner's behalf with all costs payable by the owner, with the agreed builder's provisional sum margin allowance specified in the contract applied.

Engineering and surveyor requirements

Should LanCon be required to provide piering to a slab edge in proximity of a Zone of Influence, or for services as per Engineer's Report, the owner understands that the piering allowance may exceed what has been allowed for in this tender and any additional cost will be at the owner's expense.

Services & Authorities 14
Water supply

Unless otherwise specified, the contract price allows that town water supply will be available from an existing main of the Local Authority prior to commencement of construction. Otherwise, the Owner is to arrange at their expense a temporary fresh water supply for building purposes to the satisfaction of the Builder, prior to site start. Client is responsible for meter connection and all associated costs. LanCon connects from the meter to the house.

Power

Power supply to the site during construction is the responsibility of the owner including connection costs. It is the owner's responsibility to set up an electricity account with the service provider when instructed by the builder and to cover the costs of the meter installation fee. Where no such power is available, the Owner is to arrange temporary power suitable to the Builder at the Owner's expense. Please note: delays in setting up the electricity account will delay the construction of your home. The underground power connection is based on a 6 m setback (unless otherwise stated); it is not to exceed 1 m from the front boundary of the contract property. The contract price does not allow for any power connections or cabling outside the boundaries of the contract property, or the installation of mains power pillar-boxes or connections to in-line supply.

Permanent property poles

Unless otherwise stated, a permanent power pole has not been included with the contract.

Gas supply

Install gas lines and testing of gas appliances to suit — LP gas includes automatic changeover regulator. Bottles are to be supplied by the Owners. Connection to natural gas to be organised by Owner. Owner to advise Builder prior to Contract Plan if gas is natural or LPG. Owner to organise run-in of gas main if natural, or organise installation of gas bottles if LPG.

Flood level requirements

No allowance has been made should local council require the level of the building platform/floor slab to be raised to meet any minimum floor level requirements. If required, then all associated costs including importing fill, machine hire, survey to determine AHD, engineers' slab design fees, local council fees, drafting fees and administration fees will be incurred by the owner and charged as a contract variation.

Development approvals

Unless otherwise allowed for under the contract, no allowance has been included in the scope of works for the project management of, or application or lodgement (including any associated fees) of Town Planning documentation. If the Building Certifier deems the project requires a Town Planning approval prior to a Building Approval, then this is the responsibility of the owner to lodge, pay all associated fees and obtain approval for, unless otherwise agreed with LanCon. Unless otherwise stated, no allowance for extra conditions has been included.

Height certificate

Unless otherwise allowed for under the contract, no allowance for a height certificate has been included in the scope of works. Please note that the current building regulation is a maximum building height of 9500 mm and/or a wall height of 7500 mm above natural ground level; however, any building to be constructed within 300 mm of the maximum building height requires an additional survey to be provided to the certifier to confirm that the building will comply within the building regulations.

Build over stormwater

Unless otherwise allowed for under the contract, no allowance has been included to provide a design assessment, engineering, Queensland Urban Utilities application fees or certification for a Build Over Sewer.

CCTV

In addition to Clause 15 of the General Conditions of Contract and unless otherwise allowed for under the contract, if Council nominate a requirement for CCTV footage of stormwater drains before and after works (due to building over/near stormwater), this will be an additional cost which will be payable by the Owner in accordance with Clause 19 of the General Conditions of Contract.

Privacy screening

Privacy screens are subject to assessment under the Small Lot Code and scope of works may vary subject to Building Approval requirements. Unless otherwise allowed for under the contract, no allowance has been included and this will be determined by the Certifier during construction inspections.

Driveway crossover application

Unless otherwise allowed for under the contract, no allowance has been included for a driveway crossover application.

Bushfire

Climate/bushfire code requirements will vary depending on individual site conditions. Any additional building requirements due to Fire Rating Assessments will be additional cost to the Owner.

Covenant requirements

Any extra works, labour or materials due to building covenants by Developer or Council not covered in the standard inclusions will be an additional cost to the Owner.

Energy efficiency

Your new home has been designed in accordance with Queensland Development Code 4.1 — Sustainable Buildings, 6-star energy efficiency rating. To meet the required rating the builder has allowed for the following energy efficiency materials within your home: R1.5 wall batts to all external walls, R2.0 ceiling batts to all roof spaces and Sisalation to all external walls. If additional products are required based on your design, additional costs will be passed on to you by way of variation. This house/development is subject to local council assessment using the Nationwide House Energy Rating Scheme plus Brisbane Rating Scheme. Items that may be affected are windows, hot water systems, additional shading devices, increased insulation, solar panels required, eaves, etc. Any additional costs relating to the above assessment will be an additional cost to the contract, borne by the owner. The specified energy efficient requirements may change subject to external colours selected. Dark coloured roofs and external walls may require additional energy rating requirements which will be nominated on the completed Energy Efficiency report and will be an additional cost if not already included in the scope of works.

Warranties & Defects 4
Structural warranty

You have a six (6) year structural warranty on the dwelling. Please note that driveway, pathway concrete, landscaping and fencing are not structural elements of the dwelling and therefore not covered by the builder's six-year guarantee.

Manufacturer warranties

All warranties for appliances, hot water systems, etc. are the responsibility of the Manufacturer. For claims regarding these items please refer to the instruction manual for the item affected. All materials are provided as per manufacturer's supply and are subject to manufacturer's warranty terms and conditions. All supplied materials are warrantied to acceptable tolerances as outlined by Australian Standards, manufacturer's design or BCC design criteria. Your builder cannot provide warranty on timber posts against weathering, splitting or warping, and your builder does not provide warranty against weather entering pivot doors. Dark paint colours may void supplier warranties which LanCon will not be covering replacement or rectification for. Please ensure colours chosen have an LRV of <40%.

Defects liability period

After practical completion and prior to expiration of the Defects Liability Period, you are to provide your Builder a written list of any alleged defects. Your Builder is not responsible for rectifying any alleged defects which are due to something still to be supplied or completed by the Owner, or for an item or thing altered or amended by the Owner.

Maintenance period

Your builder provides a 12-month maintenance period from the practical completion date of your home in accordance with the provisions of standard policy.

Owner Responsibilities 7
Owners responsibilities

Disconnection of existing services, rainwater tanks, tree removal from site, retaining walls and rock excavation will all be carried out at the Owner's expense.

Owner supplied items

Any owner supplied (and/or installed) items are to remain the responsibility of the owner. LanCon will not accept responsibility for any damaged, stolen or faulty products on site. All quantities and take-offs are to remain the responsibility of the owner. Owner's responsibilities include but are not limited to the following: any Owner supplied items are to have all product model, specification and installation documentation provided to the Builder prior to contract signing; items supplied must meet the current legislation regarding the supplied items; liaise with the site supervisor for when the item is required on site; any delays caused by owner supplied items may incur variation costs and extensions of time; LanCon cannot provide warranty or maintenance on any owner supplied materials, and LanCon or LanCon subcontractors can refuse installation if not to Australian Standards or by their judgement.

Keys, access by owners and official handover

During construction, the builder is solely responsible for the health and safety of all people on the site. It is standard policy to NOT provide keys until official handover. Due to Workplace Health and Safety Regulations, the owner is not permitted to enter the property at any time during construction (including after hours and weekends) without the express permission of the builder. Persons entering the site must be accompanied by a duly authorised representative of the builder and all personnel must comply with WHS regulations for PPE requirements. Closed safety footwear must always be worn on site. Persons failing to adhere to these rules will be ejected from the site. Whilst every effort will be made, please try to allow 48 hours' notice for the supervisor to provide access to the site. Payment must be paid in full prior to the release of keys. Handover will take place within two weeks of Practical Completion.

Surplus material

All and any surplus building materials remain the property of LanCon.

Termite

Where the exposed slab edge is forming part of the management system, a minimum of 75 mm must be maintained above the surrounding levels and must not be rendered, tiled or covered by soil/bark chip to conceal termite activity. The slab edge may be painted. LanCon will provide, from the manufacturer, product warranties extending to all materials used in the termite barrier. It is the Owner's responsibility after handover to ensure that regular inspections are carried out on the home and all visual barriers are maintained clear of debris, applied finishes or landscaping. The Owner agrees to pass on the information about the maintenance of the termite barrier for the life of the building to any subsequent Owner.

Fencing

Unless otherwise allowed for under the contract, no allowance has been included for the removal or reinstatement of any boundary fence. Should the fence be required to be removed for construction purposes, any costs incurred will be forwarded to the owners by way of variation. The owner will be advised of any fence sections requiring to be altered, and it will be the owner's responsibility to obtain/confirm permission from adjoining neighbours. Any cost sharing for dividing fences is the responsibility of the Owner to negotiate with the adjoining owner.

Cleaning / neighbouring properties

We have only included a builder's clean, which is not at the same level as a domestic spotless clean. LanCon is not liable for any cleaning to neighbouring properties due to wind and weather conditions. Any requests from neighbouring properties will be forwarded to you for negotiation and processing. LanCon does not cover neighbouring properties and requests.

Copyright

The designs and this specification always remain the copyright and intellectual property of Elevate Design Studio and LanCon and cannot be copied or used for any purpose other than the construction of the home at the site address shown on the accompanying plan. The plans may be copied to provide to contractors for the purposes of quoting on work to be carried out only on the property noted in the accompanying plans.

Precedence

Written detail always takes precedence over drawings. Details specified in this inclusions schedule have precedence over plans and working drawings where such item does not have an impact on the structural integrity of the structure.

Construction plans and inclusions

Please note that Construction Plans and the Personal Inclusions list supersede all Standard inclusions. Any illustration is an artist's impression only and does not represent part of the contract.

Materials and colours

The colours, finishes and materials will be as nominated in this Specification, the Schedule of Amendments to Standard Inclusions, and the Schedule of Standard Inclusions which form part of the contract documentation. Colours may vary from those indicated in brochures, samples or colour boards due to changes in base materials used, or different manufacturers using similar product descriptions. LanCon reserves the right to amend the material specification and change suppliers from time to time without notice, providing the items supplied will always be of a similar quality to that noted in the Schedule of Standard Inclusions.

Available colours and finishes

We cannot take responsibility for any colour variation in the roof tile, Colorbond, brick, ceramic wall and floor tile, stone or granite bench tops or any other product, between those shown in displays or brochures to those delivered by the manufacturer. These products may vary slightly in colour from time to time and any discrepancy is the responsibility of the manufacturer. Please ensure that all colour selections are in writing and signed by the Owner to ensure that you receive the products ordered.
